Personal data protection

This English translation is provided for information only. The French version of this page is the authoritative version.

The notarial office processes personal data concerning the persons mentioned herein in order to carry out notarial activities, in particular the formalities relating to deeds.

This processing is based on compliance with a legal obligation and on the performance of a task carried out in the exercise of the official authority delegated by the State to notaires as public officers, in accordance with Ordinance no. 45-2590 of 2 November 1945 (ordonnance n° 45-2590 du 2 novembre 1945).

These data may be transferred to the following recipients:

  • Legally authorised authorities or partners such as the French public finances directorate (Direction Générale des Finances Publiques) or, where applicable, the land register (livre foncier), notarial bodies, organisations of the notarial profession and the central registers of the notarial profession (Fichier Central Des Dernières Volontés, Minutier Central Électronique des Notaires, PACS register, etc.),
  • The notarial offices taking part in or contributing to the deed,
  • The financial institutions concerned,
  • Specialised advisory bodies for the management of notarial activities,
  • The Conseil supérieur du notariat or its delegate, to produce the statistics used to value real property, pursuant to Decree no. 2013-803 of 3 September 2013 (décret n° 2013-803 du 3 septembre 2013),
  • Public or private bodies carrying out checks to identify politically exposed persons or persons subject to asset freezes or sanctions, and to combat money laundering and terrorist financing. These checks involve a transfer of data to a country outside the European Union, governed by the signature of standard contractual clauses of the European Commission intended to ensure a level of data protection substantially equivalent to that guaranteed in the European Union.

Disclosure of these data to these recipients may be essential for carrying out notarial activities.

The documents used to draw up, register and publish deeds are kept for 30 years from the completion of all formalities. The authentic deed and its appendices are kept for 75 years, and for 100 years where the deed concerns minors or protected adults. Checks relating to politically exposed persons, money laundering and terrorist financing are kept for 5 years after the end of the business relationship.

In accordance with the regulations in force on the protection of personal data, data subjects may request access to the data concerning them. Where applicable, they may request that these data be rectified or erased, obtain the restriction of their processing or object to it on grounds relating to their particular situation. They may also set out instructions concerning the retention, erasure and communication of their personal data after their death.

The notarial office has appointed a Data Protection Officer, whom data subjects may contact at the following address: dpo.not@adnov.fr.

If, after contacting the notarial office, data subjects consider that their rights have not been respected, they may lodge a complaint with a European supervisory authority, which for France is the Commission Nationale de l’Informatique et des Libertés.
