Court-ordered acceptance of a house must be set at the date on which it is habitable
Under Article 1792-6 of the French Civil Code, acceptance is the act by which the project owner declares that they accept the works, with or without reservations; failing an amicable agreement, acceptance is ordered by the court, after hearing both parties.
The French Supreme Court (Cour de cassation) specifies that, where it is requested, court-ordered acceptance must be set at the date on which the works are fit to be accepted — that is, for a dwelling house, the date on which it is habitable, regardless of whether the project owner wishes to accept it.
